Special Education Programs Disabled Students: IHBA

In keeping with the intention of the state of Colorado to offer educational opportunities to all students which will enable them to lead fulfilling and productive lives, the district shall provide appropriate special education programs to all students within its jurisdiction, who qualify for special education pursuant to the Colorado Exceptional Children’s Education Act (ECEA) and the Federal Individuals with Disabilities Education Act (IDEA).
Accordingly, the district shall make appropriate public education available free to all children with disabilities, as defined by law, between the ages of three and 21 who have not received a high school diploma, received a GED or otherwise completed high school graduation requirements.
All children with disabilities between the ages of three and 21 shall be provided an individualized educational program appropriate to meet their educational needs.
Children with disabilities shall become eligible for services on their third birthday. A youth reaching the age of 21 after the beginning of an academic year shall have the right to complete the semester in which the 21st birthday occurs or attend until he meets requirements for graduation, whichever occurs first.
Children with disabilities shall, as deemed appropriate by their IEP Team, be included in state and district-wide assessments, with appropriate accommodations as provided by law. Any IEP developed for children with disabilities shall specify whether the student shall achieve the district’s adopted content standards or whether the student shall achieve individualized standards which would indicate the student has met the requirements of his or her IEP.
In addition to notice afforded by publication of this policy, the district shall take additional steps to notify the general public that all children and youth from birth through age 21 who are suspected of having an educational disability and being eligible for special education have a right to a formal determination as to such disability and eligibility, if any.
The Superintendent shall have the final determination on placement of all children with disabilities.
